Privacy Policy

1. Information we collect

Account information: your name, email address, password (stored only as a one-way hash), language and notification preferences, and two-factor authentication secrets if you enable them.

Google sign-in: if you sign in with Google, we receive your name, email address and profile picture from your Google account. We use them only to identify you and sign you in to a workspace you are already a member of. We do not request or access Gmail, Drive, Contacts or any other Google data.

Workspace data: WhatsApp contacts, conversations, messages and media, notes, tags, templates, broadcasts, product and price lists, and settings. This data belongs to the organisation that owns the workspace (the controller); Fakarly processes it on that organisation's instructions.

Technical information: IP address, browser and device type, timestamps, an audit log of actions taken in the workspace, and error reports.

2. How we use information

To provide and operate the Service: sending and receiving WhatsApp messages through Meta's WhatsApp Business Platform, team inbox, automations and reports.

To generate automatic or suggested replies when a workspace enables the AI agent.

To send transactional emails such as email verification, password reset, invitations and service alerts.

To keep the Service secure: authentication, two-factor verification, rate limiting, abuse and fraud prevention.

To provide support and to comply with legal obligations. We do not sell personal data and we do not build advertising profiles.

3. How we share information

Meta Platforms, Inc. (WhatsApp Business Platform) receives message content and recipient numbers in order to deliver messages.

AI providers (currently Anthropic) receive message text when a workspace has enabled AI replies, solely to generate the reply.

Email delivery, hosting and infrastructure providers process data on our behalf under contractual confidentiality and security obligations.

Public authorities, when required by applicable law or a valid legal request.

4. Google user data

Fakarly's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

Google account data is used only for authentication. It is never used for advertising, never sold, and never transferred to third parties except as needed to provide sign-in, to comply with law, or as part of a merger or acquisition with notice to you.

5. Retention and deletion

Account information is kept while your account is active. Workspace owners can set a message retention period after which messages and their media are deleted automatically.

Workspace owners and admins can export a customer's data or erase it permanently from the contact profile. Deleting your account removes your personal data within 30 days, except where the law requires us to keep it. Backups are rotated within 30 days.

6. Security

Data is encrypted in transit (TLS). Channel credentials are encrypted at rest, passwords are hashed, access is role-based, and two-factor authentication can be required for sensitive roles. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

7. Your rights

Depending on where you live (including under the Saudi PDPL and the EU/UK GDPR) you may have the right to access, correct, delete, restrict or export your personal data, to object to processing, to withdraw consent and to complain to a supervisory authority.

8. International transfers, children and cookies

Data may be processed in the countries where we and our providers operate, with appropriate safeguards.

The Service is intended for business users aged 18 and over.

We use essential cookies only (session, language and theme). We do not use third-party advertising cookies.

We will post any changes on this page and update the date above. Material changes will be announced by email or in the app.
